What's the acid test for deprivation of liberty?
The "acid test" comes from Cheshire West [2014] UKSC 19. A person who lacks capacity is deprived of liberty if they are (1)  under continuous supervision and control and (2)  not free to leave. The person's relative normality or contentment is irrelevant.
Does it apply in a domestic setting?
Yes. Article 5 ECHR applies regardless of the setting. A deprivation can occur in a person's own home, a supported living placement, or a foster home — not just hospitals and care homes. The key is the concrete situation, not the label attached to the placement.
